The Tarpotsfireworks.co.uk Site is provided to you free of charge for your personal use subject to these Terms and Conditions and our Privacy and Cookies Policy. By using the website you agree to be bound by these Terms and Conditions and our Privacy and Cookies Policy.

The Tarpotsfireworks.co.uk Site is made up of a number of stores, for example, Tarpots Fireworks Click and Collect, Tarpots Fireworks Home Delivery and Tarpots Fireworks Display Service. These Terms and Conditions govern your use of the website and Online Stores and all services provided in connection with these.

All products offered for sale on this website have been selected by our team of highly qualified pyrotechnicians, however, no liability can be accepted for the products offered for sale. All products are approved for sale in the UK and have undergone testing to BS 7114:Part2:1988 and EU equivalent regulations.

Images and video's found on the website are uploaded as examples, no liability can be accepted for any variations found in the actual article.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.


Legal firing times

In the United Kingdom, there are set legal times in which fireworks can be activated. Fireworks must not be lit after 11pm except for the following occasions:

New Years Eve: 1am
Chinese New Year & Diwali (and its proceeding three days, respectively): 1am
November 5th: Midnight

Any fireworks lit and fired after this time can be viewed as a criminal offence, Tarpots Fireworks accepts no responsibility for any legal action following the activation of a firework after the legal time.

Tarpots Fireworks' display teams will not begin displays if there is not ample time to complete the display within the legal timeframes. For any delays caused by external factors, refunds may not be issued if the display team arrives in good time for the event.

It is illegal to let fireworks off in the street or a public place. You should only let fireworks off on private land such as your garden or on land where you have the landowner’s permission.


Amendments

We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the website. The changes will apply to the use of the Tarpotsfireworks.co.uk Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the the Online Stores. If you continue to use our service after the date on which the change comes into effect, your use of the service indicates your agreement to be bound by the new Terms and Conditions.


Registration

To register and create purchases with Tarpotsfireworks.co.uk you must be over eighteen years of age and a resident in the United Kingdom.

Unless expressly stated otherwise at the time of issue of the coupon:

Each issued coupon will be valid for use by a recipient only once,

• Only one coupon will be valid for use per customer or household, as the case may be, and,
• A coupon may not be used in conjunction with any other special offer or coupon.
• Coupons cannot be exchanged for cash or used to purchase gift-vouchers.

Coupons may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the coupon, in which case notice will be given to you at the time of issue of the coupon.

Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.


Minimum spend requirements

Where the redemption of an coupon is subject to a minimum spending requirement, the redemption is only permitted in respect of the purchase of qualifying products which will be communicated to you at the time of issue of the coupon. Excluded products and supplementary charges, such as delivery, shall not count towards a minimum spending requirement.

If more than one minimum spend offer is valid for use in an order, there must be sufficient qualifying spend to meet the requirements of each offer in total. For example, to use a £3 off £30 coupon and a £5 off £50 coupon in the same transaction (assuming that these coupons can be used together), you must spend at least £80.


Calculation of discount

Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.

Supplementary charges such as delivery or postage & packing shall not be discounted unless specifically stated in the offer description.


Security and Fraud

At all times our acceptance of an order takes place on written confirmation of the order, at which point the purchase contract will be made and you will be charged for your order.

All offers are subject to availability and while stocks last.

Tarpots Fireworks shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any coupon or any failure or inability of a customer or household to use an coupon for any reason.


Miscellaneous

We reserve the right to vary or terminate the operation of any coupon at any time without notice.

The failure of Tarpots Fireworks to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Tarpots Fireworks reserves its rights in respect of these terms and conditions at all times.


Refunds on promotional offers

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.


Excluded Services

The services provided by the Tarpotsfireworks.co.uk do not include the provision of computer or other necessary equipment to access the website. To use the site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.


Expiry Date on Payment Card

Please ensure that the expiry date of your payment card is after the anticipated delivery date of your order. Payment is taken at the point of order confirmation and in the event that the payment card has expired we will be unable to take payment and fulfil your order.


Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
